MALTA JIU JITSU ACADEMY
RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK
AND INDEMNIFICATION AGREEMENT
This Release of Liability, Waiver of Claims, Assumption of Risk, and Indemnification Agreement (“Agreement”) is entered into by the undersigned participant (“Participant”), or the parent/legal guardian if the Participant is under eighteen (18) years of age, in favor of Malta Jiu Jitsu LLC, doing business as Malta Jiu Jitsu Academy, located in Malta, New York, including its owner, instructors, coaches, assistants, employees, volunteers, agents, members, and representatives (collectively, the “Released Parties”).
1. Assumption of Risk
Participant understands and acknowledges that Brazilian Jiu Jitsu, grappling, martial arts training, sparring, strength and conditioning, and related activities involve inherent risks. These risks include, but are not limited to, cuts, bruises, sprains, strains, dislocations, fractures, concussions, serious bodily injury, permanent disability, or death.
Participant knowingly and voluntarily assumes all risks associated with participation.
2. Release and Waiver of Liability
Participant hereby releases, waives, discharges, and covenants not to sue the Released Parties from any and all claims, demands, damages, losses, or causes of action arising out of or related to participation in activities at or affiliated with Malta Jiu Jitsu Academy, including those caused by the ordinary negligence of the Released Parties, to the fullest extent permitted by New York law.
3. Medical Acknowledgment
Participant represents that they are physically and mentally capable of participating in martial arts training and have no medical condition that would prevent safe participation, or that such conditions have been disclosed.
Participant authorizes emergency medical treatment if deemed necessary and understands that all medical expenses are the Participant’s responsibility.
4. Indemnification
Participant agrees to indemnify and hold harmless the Released Parties from any claims, actions, damages, or expenses, including reasonable attorney’s fees, arising from Participant’s actions or participation.
5. Code of Conduct and Safety
Participant agrees to follow all academy rules, safety guidelines, instructor directions, hygiene standards, and behavioral expectations. Malta Jiu Jitsu Academy reserves the right to remove any participant whose behavior is unsafe, disruptive, or inappropriate.
6. Photo and Video Release
Participant grants permission for Malta Jiu Jitsu Academy to use photographs or video recordings taken during classes, training sessions, or events for promotional, educational, or marketing purposes without compensation, unless Participant provides a written opt-out.
7. Minors
If the Participant is under eighteen (18) years of age, this Agreement must be signed by a parent or legal guardian. The parent or guardian agrees to all terms on behalf of themselves and the minor.
8. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the State of New York.
9. Severability
If any provision of this Agreement is determined to be unenforceable, the remaining provisions shall continue in full force and effect.
10. Acknowledgment of Understanding
Participant acknowledges that they have read this Agreement carefully, fully understand its contents, and voluntarily agree to be bound by its terms.
